  14. SUMMARY: This notice announces Agency approval of applications submitted by
  15. Acetochlor Registration Partnership, to conditionally register the pesticide
  16. products Acetochlor Technical and Acetochlor EC containing new active
  17. ingredients not included in any previously registered products pursuant to the
  18. provisions of section 3(c)(7)(C) of the Federal Insecticide, Fungicide, and
  19. Rodenticide Act (FIFRA), as amended.

  27. SUPPLEMENTARY INFORMATION: EPA received applications from Acetochlor
  28. Registration Partnership (c/o ICI Americas and Zeneca Agricultural Products)
  29. P.O. Box 751, Wilmington, DE 19897, to conditionally register the herbicide
  30. products Acetochlor Technical and Acetochlor EC (EPA Registration Numbers
  31. 66478─1 and 66478─2) containing the active ingredients acetochlor,
  32. 2-chloro-N-(2-ethyl-6-methylphenyl)acetamide and acetochlor
  33. 2-chloro-2'-methyl-6'-ethyl-N-ethoxymethylacetanilide at 92 and 81.15 percent~
  34. respectively, active ingredients not included in any previously registered
  35. products. Both products contain a different formulation of the chemical
  36. acetochlor. However, since the notice of receipt of applications did not
  37. publish in the Federal Register, as required by section 3(c)(4) of FIFRA, as
  38. amended, interested parties may submit written comments within 30 days from
  39. the date of publication of this notice.

  41. The applications were approved on March 11, 1994, as Acetochlor Technical for
  42. formulation of herbicide products only (EPA Reg. No. 66478─1) and for
  43. restricted use of Acetochlor EC for use on (corn) field, silage, and pop (EPA
  44. Reg. No. 66478─2).

  47. A conditional registration may be granted under section 3(c)(7)(C) of FIFRA
  48. for a new active ingredient where certain data are lacking, on condition that
  49. such data are received by the end of the conditional registration period and
  50. do not meet or exceed the risk criteria set forth in 40 CFR 154.7; that use of
  51. the pesticide during the conditional registration period will not cause
  52. unreasonable adverse effects; and that use of the pesticide is in the public
  53. interest.

  55. The Agency has considered the available data on the risks associated with the
  56. proposed use of acetochlor~~, and information on social, economic, and
  57. environmental benefits to be derived from such use. Specifically, the Agency
  58. has considered the nature of the chemical and its pattern of use, application
  59. methods and rates, and level and extent of potential exposure. Based on these
  60. reviews, the Agency was able to make basic health and safety determinations
  61. which show that use of acetochlor~~ ~~during the period of conditional
  62. registration is not expected to cause any unreasonable adverse effect on the
  63. environment, and that use of the pesticide is in the public interest.

  65. Consistent with section 3(c)(7)(C), the Agency has determined that this
  66. conditional registration is in the public interest. Use of the pesticides are
  67. of significance to the user community, and appropriate labeling, use
  68. directions, and other measures have been taken to ensure that use of the
  69. pesticides will not result in unreasonable adverse effects to man and the
  70. environment.

  76. chemical, use patterns and formulations, science findings, and the Agency's

  80. In accordance with section 3(c)(2) of FIFRA, a copy of the approved label and
  81. the list of data references used to support registration are available for
  82. public inspection in the office of the Product Manager. The data and other
  83. scientific information used to support registration, except for material
  84. specifically protected by section 10 of FIFRA, are available for public
  85. inspection in the Public Response and Program Resources Branch, Field
  86. Operations Division (7506C), Office of Pesticide Programs, Environmental
  87. Protection Agency, Rm. 1132, CM ±2, Arlington, VA 22202 (703─305─5805).

  89. Freedom of Information Act and must be addressed to the Freedom of Information
